Notorious Psych Ward at Miami-Dade Jail Finally Shuttered

In a historic culmination to decades of “horrific” living conditions and a pattern of constitutional violations, the Miami-Dade County Jail in Florida has finally closed the “Forgotten Floor” – the notorious ninth floor at the facility that was used to house mentally ill prisoners, often for months and years at a time, with levels of care so abysmal that prisoners routinely died.

“It is thrilling on one level but kind of sad that it has taken so long,” said Miami-Dade Judge Steve Leifman of the December 23, 2014 closure of the jail’s ninth floor. “A lot of people have been hurt or died up there.” Leifman, as chair of the 11th Circuit Mental Health Project, has been a long-time advocate for the mentally ill.

In 2013 alone, three mentally ill prisoners housed on the ninth floor died. On August 26, Joseph Wilner, 59, was found “unresponsive” in his cell; jailed for driving on a suspended license, he was in the unit reserved for the most acute mental cases.

In July 2013, Leifman was informed of the death of wheelchair-bound prisoner Joaquin Cairo. An employee with the jail’s diversion program told the court that Cairo said “someone propositioned him while in custody and when [he] declined they threw him against the bed and against the floor.” Cairo suffered a broken pelvis and died from internal bleeding.

“The neglect was despicable. Despicable,” Leifman said. “He should have been taken to a hospital immediately, and there is absolutely no excuse.”

Three months earlier another psych ward patient, Juan Matos-Flores, who was considered a suicide risk, died after jailers found him unresponsive on the floor of his cell. When staff tried to call 911 they were unable to do so because the phones on the ninth floor were programmed to block outgoing calls. Instead, employees were forced to call another floor to get help.

“It’s a floor that is specifically designed for people who are ill. It’s absurd,” Leifman said after learning of the telephone debacle.

When the ninth floor at the Miami-Dade County Jail closed, some 400 prisoners were transferred to six newly-refurbished wings at the Turner Guilford Knight Correctional Center, where the telephones allow 911 calls and cameras monitor prisoners in every cell.

The Miami-Dade County Jail, the nation’s eighth-largest, has been under federal monitoring since the U.S. Department of Justice concluded a three-year investigation in 2011 that found a “pattern and practice in constitutional violations” of prisoners’ rights due to deplorable living conditions.

Leifman was more blunt, calling conditions on the Forgotten Floor “horrific.”

“It was not built to be a psychiatric facility. It was built as a jail [with a cell] for one person, and here two and three people [were placed] in there that are very psychotic,” he said.

The public got its first glimpse of the infamous floor in 2006 when Leifman invited a television reporter and camera crew to document conditions as he guided a tour. “Human beings should not be treated like this. No blankets, no beds, no mattresses. We sleep on the floor,” one prisoner told CBS4 chief investigative reporter Michele Gillen, who found the faucets in cells were not working and prisoners were drinking water from the toilets. Leifman credited Gillen’s reporting with stirring public outrage which, in turn, prompted action.

“We have finally closed the ninth floor, thanks to you,” Leifman told Gillen in an interview. “I don’t think the public ever would have understood how horrendous the situation was, but for your reporting. And it led to where we are today.”

Michael Kessler was sentenced to state prison Friday for trying to lure a 13-year-old boy to meet him for sex back in 2013.

“Michael, why did you tell the court you're sorry? Are you sorry you got caught? Or are you sorry you did it?" Newswatch 16 asked Kessler. He had no response.

Former psychiatrist Michael Kessler of Cresco is headed to a state prison after his sentencing in Monroe County Court. Kessler admits trying to lure a 13-year-old by to meet him and engage in sexual activity, sending him child porn and more. The boy’s mother says she’s glad Kessler will be behind bars.

"It caused a lot of anxiety not knowing and knowing that he knew where I lived and was my friend and he targeted my son,” said the boy’s mother Janet VanHorn.

That mother says she monitors her children’s phones and Facebook accounts. Two years ago she caught Kessler posing online as a 14-year old boy and turned the case over to Monroe County Detectives.

"She paid attention. She caught it early. She was on top of things and she took the right steps,” said Detective Brian Webbe of the Monroe County Detective Office.

Kessler worked at Pocono Psychiatric Associates near Marshalls Creek before his license was revoked in 2012. Prosecutors say Kessler was arrested four other times for sexual incidents in Massachusetts and New Jersey without facing jail time.

"It makes you angry because all these years he thought he was above the law. It made me want to fight even harder to make sure he faced punishment,” said VanHorn.

Now Kessler faces a year and a half to five years behind bars. And this mother of two has a message for other parents after a long tough two years waiting for justice.

“Parents need to be aware that they need to keep up on your social media you need to check your kids' phones and their Facebook. You need to be on top of it all because if you're not, Lord knows what could have happened,” said VanHorn.

Dr Joseph Bray is faces being struck off after he had an affair with a patient at The Priory in Southampton and allegedly made sexual comments towards another

A HAMPSHIRE psychiatrist had an affair with a patient and made sexual comments about another, a hearing was told.

Now married father of two Dr Joseph Bray faces being struck off by a fitness to practice tribunal. The tribunal heard Bray began flirting with a woman known as Patient B during counselling sessions and later began a sexual relationship with her. During three consultations he stroked Patient B’s hair, kissed her on the side of the head and told her “if only I was 20 years younger”.

Mr Williams said the consultations ‘crossed boundaries’, including giving out his personal email address, and added: “The doctor has demonstrated that he is willing to cross boundaries of a relationship with Patient B and to go all the way to a full-blown relationship.” The tribunal also heard he treated a patient who came to him for help coping with her husband’s womanising by comparing her appearance against her husband’s mistress.

The hearing was told in a ‘crudely-worded’ consultation Bray, 57, used Google to search for pictures of the mistress and then compared their physical appearances.

Bray allegedly told the woman, known only as Patient A, “men aren’t biologically programmed for monogamy,” and added: ‘‘When my wife dies, I will shag as many women as I can.’’ Patient A was said to feel ‘’awkward and uncomfortable’’ over the counselling she received from Bray after she attended the £3,000 a week Priory Hospital, Southampton, in ‘‘emotional distress.’’

Paul Williams, counsel for General Medical Council, told the tribunal in Manchester:

“Dr Bray’s persistent focus on the context of emails received by the husband made her feel awkward and uncomfortable. She felt it was sufficient to say the content was explicit.
“She says she found it distressing and unprofessional for the doctor to Google her husband’s mistress and begin passing comments about women.
“These are utterly inappropriate remarks during a consultation and so deeply sexualised in nature.
"She says it was unprofessional for him to make personal remarks regarding her appearance, even if complimentary.”

Mr Williams added: “The conversation turned from simple relationship matters to physical appearance, attraction and discussing sexual matters.”

The consultant, who lives in the New Forest, had been working at The Priory Hospital since 2007. Bray admits acting inappropriately during his consultation with Patient A but denies his conduct was sexually motivated. He admits all allegations regarding his conduct and inappropriate, sexual relationship with Patient B.

GAO Finds Major Overuse of Antipsychotic Drugs by the Elderly

In late 2014 we blogged about the accusations levied against Dr. Michael J. Reinstein about his improper use of antipsychotic drugs prescribed to patients in abundance, as well as taking kickbacks from the drug maker to prescribe it, and making 140,000 or more false billing claims submitted to Medicare and Medicaid for those treatments. This activity landed him in both civil and criminal hot water, and in more recent news he pled guilty to criminal charges as well as settled civil claims with the Illinois and federal governments.

The companies accused of providing those kickbacks and receiving Medicare and Medicaid dollars from the business Reinstein generated by prescribing their antipsychotic drugs. Reinstein exemplifies a holdover of a slowly diminishing practice of using antipsychotic medications, which now is viewed more as the easy way out and a method of chemical restraint when there are other methods that could more humanely calm and care for a patient, particularly dementia and Alzheimer’s patients who have historically been the recipients of antipsychotic medications. Nursing homes historically used these especially when they kept low staffing levels and did not have the manpower to aid patients. Yet antipsychotic drugs can create a cycle of drug dependency, and can even lead to death.

Changing Tides?

While the movement to eliminate the use of antipsychotic medications has gained steam in recent years, the federal government reports that elderly Americans have been overusing psychiatric drugs such as clozapine (Dr. Reinstein’s apparent drug of choice), Abilify, and others. Such drugs are meant to calm down and sedate patients that are prone to violence or outbursts, which those suffering from dementia or psychosis may be particularly prone to exhibiting. The Government Accountability Office (GAO) has released a report stating that elderly adults who live outside of nursing homes and long-term care facilities overuse antipsychotic drugs which are prescribed to them by doctors, though residents in nursing homes also fell into such dependency and overuse, and efforts to curb over-prescription and overuse must continue there as well.

Notably, according to the report, about 86% of Medicare enrollees who suffer from dementia and live outside of nursing homes are prescribed antipsychotic medications, which is a staggering statistic. It is even more remarkable when considering that only approximately 6% of total Medicare enrollees living outside of nursing homes suffer from dementia. Thus the choice of treatment has predominantly been geared toward chemical intervention. For those in nursing homes, of the elderly dementia patients living in nursing homes for over 100 days in the year 2012, approximately a third of those patients were prescribed antipsychotic drugs (and 14% of those outside of nursing homes during 2012).

Part of the problem, according to the GAO report, is the lack of oversight by the government. Medicare and Medicaid specifically take responsibility for such oversight on behalf of the federal government, and states typically have Medicaid fraud units that look into not only financial fraud related to health care, but also investigate when issues include abuse or misuse of medications (which can result in unnecessary and excessive, and thus fraudulent, payments to providers and pharmaceuticals with federal dollars). Those agencies and offices, as well as the U.S. Department of Health and Human Services as the report notes, should be vital in promoting awareness of the dangers of antipsychotic drugs and reducing that use far more than the government has in the past.

Long Island woman says psych ward doctors believed she was delusional for insisting Obama follows her on Twitter

A Long Island woman’s insistence that President Obama follows her on Twitter made doctors at the Harlem Hospital psych ward think she was delusional and suffering from bipolar disorder — but she was actually telling the truth, a lawsuit charges. Kam Brock’s frightening eight-day “One Flew Over the Cuckoo’s Nest” ordeal at the mental facility included forced injections of powerful sedatives and demands she down doses of lithium, medical records obtained through her suit filed in Manhattan Federal Court show. They also indicate that doctors didn’t believe the leader of the free world followed her on Twitter — though @BarackObama follows over 640,000 accounts, including hers. They were also skeptical she worked at a bank, records show.

“I told (the doctor) Obama follows me on Twitter to show her the type of person I am. I’m a good person, a positive person. Obama follows positive people!” Brock, whose Twitter handle is @AkilahBrock, said.

A “master treatment plan” from Harlem Hospital backs up the Astoria Bank worker’s story.

“Objective: Patient will verbalize the importance of education for employment and will state that Obama is not following her on Twitter,” the document reads.

It also notes “patient’s weaknesses: inability to test reality, unemployment.”

Adding insult to insanity, the hospital hit Brock with a bill of $13,637.10, she charges in her suit seeking unspecified damages.

The bizarre experience began Sept. 12, when the NYPD seized her prized 2003 BMW 325Ci in Harlem because they suspected she was high on weed, her attorney, Michael Lamonsoff, said. Cops found no marijuana but confiscated her ride anyway, he said. The NYPD declined to comment.

The following day, Brock walked into the NYPD’s Public Service Area 6 stationhouse in Harlem to retrieve her car, her suit charges. Brock — an eccentric 32-year-old born in Jamaica with dreams of making it big in the entertainment business — admitted in an interview she was “emotional,” but insisted she in no way is an “emotionally disturbed person.” Nevertheless, cops cuffed her and put her in an ambulance bound for the hospital, her suit charges.

“Next thing you know, the police held onto me, the doctor stuck me with a needle and I was knocked out,” Brock said, tearing up. “I woke up to them taking off my underwear and then went out again. I woke up the next day in a hospital robe.”

Lamonsoff said race may have been a factor in the way Brock was treated. “How would you act if you were being told you were crazy?” he said. For eight days, she attended group therapy, endured injections of sedatives, and took lorazepam and lithium, medical records show, according to Lamonsoff.

When she was finally let go, the doctors didn’t tell her why she was being allowed to leave, Brock said. Harlem Hospital declined to comment. The city Law Department said the suit would be reviewed.

British Psychiatrist Adam Osborne is suspended AGAIN... over 'serious misconduct' with female patient

Adam Osborne, 38, who has a private practice in Central London, last week had his licence suspended by the General Medical Council (GMC) after being accused of having a two-year sexual affair with a highly vulnerable woman patient who has psychiatric issues, is married and has two children. The news comes five years after he was suspended by the GMC for ‘dishonest and misleading’ behaviour in prescribing drugs to his cocaine-addicted prostitute lover. The latest blow means he cannot practise in any capacity as a doctor until an investigation into the new allegations has been concluded. The suspension will prove highly embarrassing for (his brother) the Chancellor (George Osborne), coming as he prepares for Wednesday’s crucial Budget, the last before May’s General Election. If the investigation results in a Fitness To Practise hearing, which is held in public, Dr Osborne could face further sensitive personal information being revealed. And if the allegations are upheld, he could be struck off. In the wake of the hearing, Dr Osborne’s personal website was taken down. His Linkedin page states that he has a special interest in adult attention deficit hyperactivity disorder, personality disorders, depression and anxiety. Dr Osborne currently runs Devonport Psychiatry, which is based in Marylebone, Central London, but is officially registered to his home address in Shepherd’s Bush, West London, which he shares with his wife Rahala Noor, a plastic surgeon. His suspension in 2010 stemmed from a series of allegations surrounding his use of prescription drugs, which centred on allegations of a relationship with a prostitute. The GMC said that his ‘relationship’ with the woman had ‘clouded his judgment’ and led him to prescribe powerful anti-psychotic drugs, dishonestly use a false name and fail to inform her GP. Dr Osborne was also disciplined for prescribing contraceptive pills to his then girlfriend, Rahala, a strict Muslim who would become his wife, and an anti-smoking drug to an unnamed family member. The GMC hearing was told that Dr Osborne had been in a relationship with the prostitute, referred to as Miss B, from 2007 to 2008 while he was separated from his girlfriend and he was a trainee psychiatrist in Manchester.

Another case of a person being diagnosed as mentally ill for the convenience of the doctors, not to help the patient. Apparently they wanted to put here on anti-psychotics to shut her up.

Alice Zhang says she's being denied a life-saving kidney transplant because doctors at Vancouver General Hospital have decided she is mentally ill.

The 45-year-old mother of two, who speaks only Cantonese, and her family say she has no history of mental illness, and that she was only removed from the transplant list for complaining about her treatment in the hemodialysis unit.

"That's what started this whole situation" Zhang, speaking through an interpreter, told CBC Investigates.

She said doctors threatened to admit her involuntarily under the Mental Health Act.

"They said if I kept making noise, they would drag me into the mental-health ward and diagnose me as having mental illness."

Zhang said that is where she ended up on two occasions.

Polycystic kidney disease

Zhang has polycystic kidney disease. She shares custody of her boys, aged nine and 11 years old.

She needs hemodialysis three times a week, and has been on the kidney transplant list since 2009.

She said a sudden diagnosis of delusional disorder came right after she filed written complaints that nurses were too rough on her injection site.

"They said, 'Right now, we are going to temporarily stop the transplant process,'" said Zhang. Hospital documents confirm that the process was halted.

"Because I complained about them, they said that to me."

According to a psychiatrist’s handwritten notes, Zhang was paranoid.

Difficult but not delusional, says family

Zhang's husband, from whom she is separated, believes doctors are misinterpreting her actions.

"If they don't even understand what she's saying, how can they say she has a mental illness?" said Lea Kwong Chow.

"This person doesn't really have great social skills. Just because of that, you can't say they have a mental illness."

Chow said that in the nearly 20 years he has known Zhang, she has never shown any signs of paranoia.

While a translator attends most appointments, Chow and Zhang said there are many informal interactions without one.

In October, the psychiatrist's handwritten note to Zhang raised concern that she was following a nurse.

"You were asking about her last name. This was interpreted as concerning behaviour," the note said.

The notes show Zhang tried to explain she had been asked to find out the nurse's last name by her lawyer, something he confirmed in a letter to Vancouver Coastal Health.

The same psychiatrist wrote, "The fact that you believe that the nurses are trying to harm you tells me that you have a mental illness ... the nurses are starting to feel threatened by you. Some of this has to do with your complaints about them."

But Zhang — who refused to take prescribed anti-psychotic drugs — said she has never said anyone tried to hurt her on purpose.

"I have never been the suspicious type," she said. "I believe they have violated my human rights."

Lawsuit describes string of sex assaults at Seattle Children's Hospital - Hospital staff failed to help girl abused in psychiatric ward

A former patient at Seattle Children’s Hospital has sued, claiming hospital staff failed to notice as she was repeatedly, sexually assaulted by another patient.

Attorneys for the young woman claim at least three other children have been sexually abused at the Laurelhurst neighborhood facility in recent years. Despite assurances of reform from hospital managers, they contend too little is being done to protect children there.

Writing the court, attorneys Steve Berman and Marty McLean said their client was just one of an unknown number of children abused while locked in Children’s inpatient psychiatric unit.

“Sadly, (she) is not the first child-patient who was sexually victimized while admitted,” Berman said in the lawsuit, which was filed earlier this week. “Publically available records confirm that (she) was at least the fourth patient in a five-year span to have been sexually victimized while under (Children’s) care and custody.”

Berman, a nationally prominent attorney specializing in class-action lawsuits, went on to say he believes “there are more children who have been victimized, as well.”

A spokeswoman for Seattle Children’s declined to comment on the lawsuit. Attorneys for the University of Washington-affiliated nonprofit have not yet responded to the allegations in court.

The Judge in the case had especially harsh words for the psychiatrist assigned to the case.

A truck driver will spend at least 17 years in jail for the sexual abuse of his daughter in one of the longest sentences handed down to a paedophile father in Australia.

In sentencing the 49-year-old man, who cannot be named to protect the identity of his daughter, Judge Paul Conlon said it was what the community expected.

Judge Conlon, who has a ­reputation for handing down tough sentences to child sex offenders, said the truck driver had exploited her youth “in the worst possible way”.

“He has groomed his own daughter, turning her into his sexual play thing,” the judge said.

He was critical of psychiatrist Dr Olav Nielssen who told the court the repeated sexual abuse over seven years had been “opportunistic”.

Judge Conlon said the psychiatrist had seemed to treat “without any critical evaluation” the man’s comments that he had trouble “showing his feelings” to his daughter and had not known how to express himself.

“In my view, it is inappropriate to use the word ‘opportunistic’ when dealing with persistent sexual abuse of a child over a period of seven years. I am unable to have much confidence in this future risk assessment,” Judge Conlon said.

His daughter, now 28, went to Queensland police in 2007. The ­father was sentenced in Queensland to a maximum of four years with a non-parole term of just one year four months after telling the psychiatrist that “he and his daughter had a very close and open relationship and that he really loved her”.

He had pleaded guilty to three counts of raping his daughter.

The veterans were lobotomized for reasons such as PTSD, depression, schizophrenia, and occasionally homosexuality.

Roman Tritz’s memories of the past six decades are blurred by age and delusion. But one thing he remembers clearly is the fight he put up the day the orderlies came for him.

“They got the notion they were going to come to give me a lobotomy,” says Mr. Tritz, a World War II bomber pilot. “To hell with them.”

The orderlies at the veterans hospital pinned Mr. Tritz to the floor, he recalls. He fought so hard that eventually they gave up. But the orderlies came for him again on Wednesday, July 1, 1953, a few weeks before his 30th birthday.

This time, the doctors got their way.

The U.S. government lobotomized roughly 2,000 mentally ill veterans—and likely hundreds more—during and after World War II, according to a cache of forgotten memos, letters and government reports unearthed by The Wall Street Journal. Besieged by psychologically damaged troops returning from the battlefields of North Africa, Europe and the Pacific, the Veterans Administration performed the brain-altering operation on former servicemen it diagnosed as depressives, psychotics and schizophrenics, and occasionally on people identified as homosexuals.

The VA doctors considered themselves conservative in using lobotomy. Nevertheless, desperate for effective psychiatric treatments, they carried out the surgery at VA hospitals spanning the country, from Oregon to Massachusetts, Alabama to South Dakota. Roman Tritz talks about the scars from his lobotomy.

The VA’s practice, described in depth here for the first time, sometimes brought veterans relief from their inner demons. Often, however, the surgery left them little more than overgrown children, unable to care for themselves. Many suffered seizures, amnesia and loss of motor skills. Some died from the operation itself.

Medical malpractice is not limited to surgery, and the case of Paul Lozano illustrates this better than any other example.

Lozano had been sexually abused by his mother as a child, and his psychiatrist, Margaret Bean-Bayog, decided to try a form of therapy known as “reparenting”, where the psychiatrist simulates the different stages of lifespan development in an attempt to “reprogram” the patient. She coddled him, read him stories, called him “baby”, made him call her “mother”, and made him learn cue-cards off by heart. One such card read “I’m your mom and I love you and you love me very much. Say that 10 times”. Other cards were more sexual, and more notes were found that appeared to be erotica featuring Lozano and his doctor. It was also reported that they did in fact have sexual relations. After about five years, he committed suicide.

When Bean-Bayog's graphic love notes were discovered, two other therapists informed state authorities. But no investigation was launched until Lozano's suicide made newspaper headlines. Even then, other psychoanalysts circled the wagons, claiming their colleague was the victim of the affair.

A Rockford psychiatrist is immediately suspended after he is accused of inappropriately prescribing medications and being involved in sexual misconduct with several female patients, according to a notice of temporary suspension from the Illinois Department of Financial and Professional Regulation.

The notice states Dr. William W. Wood is suspended as allegations against him "constitute an immediate danger to the public."

The notice details accusations that Wood violated boundaries with several female patients at his practice by sending text messages of a personal and sexual nature, kissing, touching, and hugging.

In addition, the notice alleges Wood inappropriately prescribed controlled substances, including Percocet, to at least one patient he was treating for depression, anxiety and panic attacks. The notice states that Wood was aware of that patient's history of prescription medication abuse and he continued to prescribe multiple controlled substances to her, knowing that she was overusing and overdosed on the prescribed controlled substances.

The notice goes on to state that Wood became aware that a local area Walgreens pharmacist refused to refill a prescription for this patient because she was taking too many medications. Wood instructed the patient to go to a different pharmacy.

Judge allows portion of lawsuit filed by man locked up for 19 years

A federal judge ruled last week that parts, but not all, of a Florida man's lawsuit can go forward against his former doctors at the Lincoln Regional Center, where he was locked up for more than 19 years on a misdiagnosis.

For years, John Montin's doctors said his denials that he was mentally ill were evidence that he was.

But in 2013, his treatment team agreed with him. It was a medication-induced psychosis that led to an incident in Hayes County and his commitment at the Regional Center, the team said, and a judge let him out.

In July, Montin sued his former doctors, alleging:

• that his former doctors and treatment team members had deprived him of his rights, a so-called 1983 civil rights claim, and
• that they hadn't met the standard of care, a state medical malpractice claim.

He is seeking more than $22 million in damages for incorrectly being labeled mentally ill and for unnecessarily being held and subjected to treatments he didn't need. He also is seeking $760,000 in lost wages and $10 million in punitive damages.

In a decision that was neither all good nor all bad for either side, Senior U.S. District Judge Lyle Strom refused to dismiss Montin's case, a move the doctors had sought. But the judge also refused to let Montin go forward on a number of theories, including unnecessary bodily restraint.

While the doctors' annual reports might have kept Montin in the locked hospital for more than 19 years, they hadn't shackled him to his bed or otherwise physically restrained him there.

Montin also cannot go forward on a theory that his doctors hadn't made truthful disclosures in their reports. In other words, Montin had alleged that at some point the doctors had to know his diagnosis was wrong.

But Strom did allow Montin to go forward on a theory alleging that the doctors retaliated against him because he kept filing lawsuits.

And the judge refused to throw out the case on an argument by the Nebraska Attorney General's office, which represents most of the defendants, that the state employees couldn't be sued because they were acting essentially as part of the judicial process.

"The court disagrees," Strom wrote in the order.

VA to look into overmedication reports at Tomah center

The U.S. Department of Veterans Affairs is launching an investigation into reports of overmedication and retaliatory management practices at the VA Medical Center in Tomah, the agency said Thursday.

Veterans Health Administration specialists plan to visit the western Wisconsin facility within two weeks to review medication prescription practices, the federal agency said in a statement Thursday afternoon. They also plan to send representatives from the Office of Accountability Review to look into allegations of retaliatory behavior.

"My sense is that this isn't just unique to Tomah," U.S. Rep. Ron Kind, a Democrat whose district includes Tomah. "We have a system-wide issue that needs to be addressed when it comes to pain management with our veterans."

Kind and other Wisconsin lawmakers had sent requests to Veterans Affairs Secretary Robert McDonald this week seeking an investigation

Tomah VA spokesman Scott Farley said in a statement the medical center will fully cooperate with the investigation.

A recent story from The Center for Investigative Reporting noted the number of opiates prescribed at the Tomah VA had more than quintupled between 2004 and 2012, even as the number of veterans seeking treatment there has declined. Health care professionals have complained about the medical center's practices for several years.

Politicians from both parties and government bureaucrats are rushing to look into allegations of rampant overmedication, retaliatory management practices and preventable overdose deaths at the U.S. Department of Veterans Affairs Medical Center in Tomah, Wisconsin, that The Center for Investigative Reporting revealed last week.

In the story’s wake, the VA has begun “actively reviewing allegations of retaliatory behavior and overmedication at the Tomah VA Medical Center,” said agency spokesman James Hutton. He said the facility’s chief of staff, psychiatrist Dr. David Houlihan, has been temporarily reassigned to the VA regional office while an internal investigation takes place.

But the problems disclosed should not have surprised politicians or federal officials: Health care professionals at the hospital have complained for at least five years about Houlihan’s prescription practices and his retaliatory management style – filing numerous reports with those in charge of oversight.

“It’s about time,” said Robin Weeth, a former social worker at the hospital who wrote to the VA inspector general in 2012 with a long list of allegations, including that “veterans are overmedicated and have been driving while impaired, fallen asleep while smoking and set themselves on fire.”

Today, Weeth reports that he never heard back from the inspector general.

The VA inspector general had closed an investigation into the Tomah VA before Baldwin even got in touch, in March 2014. The inspector general’s report noted that Houlihan’s narcotic prescriptions were “at considerable variance compared to most opioid prescribers” and “raised potentially serious concerns” that should be brought to the attention of the federal agency’s leadership. But the report suggested no punishment.

Weeth said he believed that Jason Simcakoski, the 35-year-old former Marine who fatally overdosed in the Tomah VA psychiatric ward in August, still would be alive today if the inspector general had come down harder on Houlihan.

Child psychiatrist discovered to have child porn conviction

A Dordrecht psychiatric clinic, which offers help from a Christian perspective, is employing a psychiatrist with a conviction for possessing large amounts of child pornography, the Volkskrant says on Monday. The man was convicted of possessing 66,000 items of child porn, including rape videos, in 2012. The board of the De Hoop clinic is aware of the conviction and says the doctor ‘deserves a second chance’.

The clinic says the psychiatrist treats adults with addiction problems and does not work with children or the perpetrators or victims of sexual violence. These conditions of employment were formulated by health ministry inspectors, the clinic said.

(The) Television programme De Monitor reported on Sunday that the man, named as Van R, continued to work with the victims of sexual abuse at a different clinic six months after his conviction. He was then sacked when news of his conviction leaked out.

Next week’s programme will focus on his work at De Hoop. Staff and patients at the clinic have now been informed about the psychiatrist’s past.

The state has paid $1.2 million to the estate of an inmate with mental retardation who died in 2008 after being kept naked for 11 days in solitary confinement and developing hypothermia.

Records from the state Insurance Reserve Fund also show the state paid an additional $199,000 to its private lawyers in the case, which was cited last year by former state Circuit Judge Michael Baxley in his landmark, 45-page order finding the state Department of Corrections had violated the rights of inmates with severe mental illness.

The estate of Jerome Laudman sued individual officers in the case in federal court and filed suit against the prison system in state court. Both cases were settled last year, records show, with the federal suit being dismissed and the state agreeing to pay $1.2 million in the state case.

"We settled the case for 1.2 million," Corrections Director Bryan Stirling said. "Corrections continues to make significant changes and improvements for the safety and security of officers and staff, inmates and the community."

Sen. Mike Fair of Greenville, chairman of the Senate Corrections and Penology Committee, said of the settlement that "$1.2 million doesn't bring this man back to life. ... (But) hopefully the family can have closure on that."

Scott Evans, a lawyer for the Laudman estate, said the family of Laudman feels the settlement was a fair one. He said the maximum amount that can be paid in a state medical negligence claim in South Carolina is $1.2 million. He said $600,000 is the limit for a wrongful death claim and $300,000 for other types of claims.

When an investigator looked at the videotape of the transfer of Laudman, he noted that it contained only a few minutes of footage before it went blank, according to the internal report.

The cell was bare, with a concrete pad for sleeping and no blanket, according to the suit. The lawsuit alleges that the entire area was cold and there were problems with the heating system.

Laudman was stripped of all "basic necessities," according to the lawsuit, including mattress, sheets, socks, shoes, underwear and uniform." He also wasn't provided access to his medication while in the Supermax cell, according to the suit.

Four days after Laudman was placed in his new cell, an officer noticed that he was sitting and stooped over "like he was real weak or sick," according to the internal investigative report.

The officer also noted that food trays were piled up near the door, Laudman was naked and the room was bare. The officer didn't report what he saw, according to the report, because when he brought up issues in the past he was told to "leave it alone."

Psychiatric Hospital Employee Accused Of Having Sexual Contact With 15-Year-Old Patient

West Virginia State Police said an employee of a psychiatric hospital in Morgantown is accused of having sexual contact with a 15-year-old male patient.

Katie Miller, 22, of Smithfield, Pa., was arrested Friday on two counts of sexual abuse of a child by a person of trust, according to a news release from the State Police.

The arrest stems from an investigation that began in late December 2014. The alleged abuse was reported by hospital officials.

During the course of the investigation, Sgt. A.W. Scott of the Crimes Against Children developed probable cause to arrest Miller. She was arraigned in Monongalia County Magistrate Court and released on a $10,000 cash or surety bond.

Psychiatrist Claudio de Novaes Soares faces hearing for sex abuse allegations

A Hamilton psychiatrist has a disciplinary hearing with the Ontario College of Physicians and Surgeons two years after allegations emerged that he sexually abused a female patient.

Dr. Claudio de Novaes Soares has not be licensed to practice medicine in Ontario since Sept. 1, 2012, around the same time he was set to take a high profile post at the University of Alberta as the head of the psychiatry program there.

Soares resigned his position with UofA around Sept. 24, two weeks after CBC News revealed allegations that he had sexual relations with a female patient while he was practicing at a Hamilton office affiliated with McMaster University.

A document outlining Soares’s disciplinary hearing at the Ontario College of Physicians and Surgeons alleges that between Nov. 2007 to May 2009 he made sexual remarks toward the female patient — referred to only as Patient A — and also engaged in fellatio and had sex with the woman.

“This behaviour constituted sexual abuse of Patient A by Dr. Soares and/or disgraceful, dishonourable or unprofessional conduct by Dr. Soares,” the document alleges.

The document also alleges Soares has “failed to co-operate” with an investigator assigned to his case.

He’s also accused of being “engaged in an act or omission relevant to the practice of medicine that, having regard to all the circumstances, would reasonably be regarded by members as disgraceful, dishonourable or unprofessional.”

Soares is set to appear at a series of disciplinary hearings in Toronto from Jan. 12-16 and Jan. 26-30, most of which will likely run throughout the entire day.

If the College’s discipline panel finds the accusations against Soares to be true, he may be reprimanded, fined up to $35,000 and his certificate of registration may be revoked.

While at McMaster, Soares was the associate chair of research in the department of psychiatry and behavioural neurosciences. He was also director of the Women's Health Concerns Clinic.

Illinois regulators have disciplined Springfield psychiatrist Dr. Duttala Obula Reddy for alleged sexual misconduct with a female patient.

Springfield (Illinois) psychiatrist suspended for ‘sexually inappropriate’ conduct

A Springfield psychiatrist who took over the care of a female patient victimized by “sexually inappropriate” conduct at the hands of another psychiatrist in the same clinic was disciplined by the state this week for sexual misconduct with the patient.

Officials from the Illinois Department of Financial and Professional Regulation issued a temporary suspension of the license of Dr. Duttala Obula Reddy, a psychiatrist at Psychiatric Associates of Central Illinois, 1124 S. Sixth St.

For the time being, the state's action prevents Reddy from continuing to practice medicine legally. Reddy, a 64-year-old Chatham resident, couldn't be reached for comment, and an office manager at Psychiatric Associates didn't return a phone call from The State Journal-Register.

According to documents from the state, Reddy began providing psychiatric care and treatment to the woman at Psychiatric Associates in 2013 after her previous psychiatrist, Dr. Kripakaran Puvalai, resigned from the clinic in September 2013.

Puvalai, 58, was suspended from the practice of medicine by the state in October 2013 for engaging “in a pattern of sexually inappropriate conduct with multiple female patients of Psychiatric Associates.” Those patients included the patient whose care was taken over by Reddy, state officials said.

Puvalai, whose license remains suspended, was disciplined for flirting with and inappropriately touching several female patients between 2009 and 2013 while he practiced at Psychiatric Associates and worked as a consulting psychiatrist at the U.S. Department of Veterans Affairs' outpatient clinic in Springfield.

Puvalai also was punished in the early 2000s by Southern Illinois University School of Medicine, during his psychiatry training in Springfield, for a lack of professional conduct and failure to maintain appropriate boundaries with patients.

Sexual violence soars in UK hospitals

Records show 50% rise in reports of sexual attacks, with more than 1,600 in past three years

A hidden outbreak of sexual abuse in British hospitals has been disclosed in new figures revealing that more than 1,600 attacks were reported to police in the last three years.

Records obtained by the Guardian under the Freedom of Information Act show a 50% rise in reports of sexual violence in hospitals since 2011. It includes a total of at least 157 rape allegations.

Statistics on sexual abuse reports in hospitals were released by 38 out of 45 UK police forces. They document 1,615 attacks that are known about including cases on NHS wards, private clinics and other health centres. But prosecutors have said that up to 90% of sexual abuse goes unreported, suggesting the true figure could be much higher.

Last year the Metropolitan police received reports of 17 rapes and 124 other sex abuse crimes inside London hospitals.

Most police forces were unable to provide a firm breakdown of the types of hospitals where rapes and sexual abuse had been reported. However, the Met, which accounted for 20% of all reports, said the issue was a particular problem in mental health units, with a significant proportion of alleged victims identified as vulnerable due to mental health problems.

Luciana Berger, the shadow minister for public health, said the figures revealed a serious problem for the NHS and called for an urgent review of hospital security.

Individual cases of abuse in hospitals have been well documented but this is the first time the scale of the problem has been reported. The figures account for all reports of abuse, although a small number are understood to relate to historic attacks that occurred before 2011.

One victim described being groomed by her mental health support officer for five months. When she bumped into him years later it triggered a suicide attempt before she eventually reported him. However, the man resigned before the investigation concluded and authorities were unable to take action against him.

“I was in a vulnerable position at the time; certainly not in a position to consent to what he was doing,” she told the Guardian. “What have I gained by coming forward? Nothing. I’m just a person who has made allegations that haven’t been proven.”

In another case, a mental health patient described psychiatric hospitals as a “playground for predators”, after she was raped up to 60 times by a member of staff. The woman had been taken to Little Brook hospital in Kent after a breakdown and was warned she would be sectioned if she tried to leave. She described her ordeal to the BBC earlier this year. “At times I was on a very heavy amount of Valium, not to where I was unconscious, but the sedative combined with my already defeated self, I was like putty. He would pull the covers back, do what he had to do and leave, all very quickly. I didn’t move.”

When asked whether anyone else at the hospital knew about her abuse, the woman said: “I strongly suspect it can’t have been completely missed. I can’t believe how it could have been so frequent and not picked up on.”

She was eventually paid £100,000 compensation, but her attacker avoided jail after receiving a suspended sentence. A third case saw the care assistant Naraindrakoomar Sahodree jailed in 2010 for repeatedly raping a multiple sclerosis sufferer in her bed at a central London hospital. He had managed to get the job despite already being struck off the nurses’ register. In court, his victim said that Sahodree made sure she could not call for help by removing her warning buzzer.

Berger said: “A zero-tolerance approach to sexual abuse must be pursued in the NHS. All victims should feel safe to come forward and every incident properly dealt with by the police, courts and health service, to ensure every perpetrator is brought to justice.”

Berger said it was particularly worrying that people in mental health units appeared to be at high risk. “These are often some of the most vulnerable patients and their safety must be guaranteed,” she said. “Ministers must order an immediate review of security, with a focus on mental health units.”

Nat Miles, senior policy and campaigns officer at Mind, said: “It’s completely unacceptable that sexual abuse is so prevalent within mental health units. Many people told us they are often seen as vulnerable and therefore an easy target by perpetrators, and are more easily discredited and less likely to be taken seriously if they report a crime.” She added: “Too often, crimes on wards are dealt with internally and not reported to police. It’s vital that frontline staff are adequately trained, so crimes are taken seriously, and dealt with quickly and appropriately.” An NHS England spokesperson said: “It is of course essential that both NHS and independent hospitals do everything to ensure that patients are safe and feel safe in their premises, and where concerns arise the police must be able to bring to bear the full force of the law.”
